A team of attorneys representing the plaintiff in this case, who is a minor and is identified in court documents as R.B., secured a six-figure settlement following a semi-truck crash.

The defendants in the case were Allstate Fire and Casualty Insurance Company and . The two companies were represented by John Weist of Luder & Weist and Matthew Greenberg of Harris & Hart in Overland, Kansas. The plaintiff, R.B., was represented by Mike Pospisil and Matt Swift of Pospisil Swift in Kansas City, Missouri.

In January of 2024, R.B. was driving east on I-435 when a semi-truck veered into her lane causing her to cross the interstate and crash into the guardrail, according to a statement from her attorneys.

After the crash, the truck driver fled the scene and couldn’t be identified. R.B. suffered a broken tibia and underwent surgery. Later on, she underwent a second surgery to remove screws in the leg, her attorneys said.

While ultimately R.B. was released from medical care without limitations, the crash has still impacted her daily life.

“Plaintiff recovered well, but the injury impacted her activities and daily living, including horseback riding and tennis, among others,” her attorneys said. “Plaintiff also suffered post-traumatic stress from the crash.”

Without the identity of the driver, R.B. had to file for the uninsured motorist policies from Allstate and Progressive.

Both of these policies had limits totaling $1.25 million, and so R.B. made a pre-suit limits demand. The insurance companies made a combined offer of $452,252.85, which they later raised to $476,717, according to her attorneys. R.B. filed suit and several months later, the case resolved for $850,000 at mediation.

Neither the attorneys for the plaintiff nor the defendants responded to requests for further comment on this story.
