Uninsured motorist crash yields six-figure settlement

A $105,849.02 settlement was reached in a motor vehicle collision in Jackson County.

The settlement was awarded to the confidential plaintiffs on March 4, 2026. Of the settlement, $100,000 was the stacked policy limit settlement for the plaintiff and $5,849.02 for the plaintiff’s minor son.

The incident occurred Aug. 22, 2025, when a father and his minor son were struck by an uninsured motorist. The father sustained multiple injuries, the most significant of which was a Weber C comminuted fibula fracture with disruption of the syndesmosis. A Weber C comminuted fracture is a serious and structurally unstable ankle injury where the fibula fractures at a point above where it joins the tibia, and the break produces several bone fragments. The father also sustained a large medial malleolar fracture to his right ankle, which is a significant injury to his inner ankle bone. This injury is also referred to as a “displaced trimalleolar fracture including displaced fracture to the distal fibula and tibia, with fracture blisters.”

On Sept. 2, the father underwent surgery on his right ankle. He was subsequently placed in a posterior splint with stirrups and a CAM boot before eventually transitioning to an ankle brace. During this time, he had to use a wheelchair, crutches or a knee scooter to move around. He was also unable to work.

The father has permanent scaring and two plates screwed into his right ankle. According to his attorney, Laurie Del Percio of The in Independence, his functional capacity following the collision will not recover to what it was beforehand.

The father incurred over $163,304.69 in medical expenses to date, of which $70,523.88 was written off.

The son visited the emergency room once on the data of the collision to be examined as a precaution.

“Analyzing the uninsured motorist policies and stacking multiple policies were instrumental in reaching this settlement,” stated Del Percio.

She had no additional comment.
