Plaintiff appealed the district court’s adverse summary judgment in its copyright infringement claim. Plaintiff sued various real estate agents, alleging that they infringed upon plaintiff’s copyrights by including floorplans of plaintiff’s home designs in real estate listings. On appeal, plaintiff challenged the district court’s award of attorney’s fees and costs.
Where the district court adequately considered the potential chilling effects of a fee award against plaintiff and appropriately evaluated the factors in determining whether to award legal fees and costs, including plaintiff’s multiple actions and lack of supporting evidence, the court found no abuse of discretion in the award of attorney’s fees and costs.
Judgment is affirmed.
