Defendant appealed the denial of his motion for post-conviction relief, which alleged that trial counsel was ineffective for failing to move for a change of venue as a matter of right within ten days of defendant’s not guilty plea.

Where defendant did not request a change of venue or advise counsel of the personal relationship between the county sheriff and the victim until after the deadline to file a motion and where defendant wished to keep his case before the assigned judge, there was no ineffective assistance from trial counsel.

Judgment is affirmed.

Anderson v. State (MLW No. 84807/Case No. SD39048 – 8 pages) (Missouri Court of Appeals, Southern District, Nickell, J.) Appealed from circuit court, Mississippi County, Horack, J. (Stephanie A. Hoeplinger, St. Louis for appellant) (Evan Buccheim, Jefferson City for respondent)
