An appeals court has largely affirmed all but about $8,000 of a $114,000 award won by a Kansas City not-for-profit organization.

The says Urban Renewal of K.C. could be compensated for having rehabilitated a house owned by the Bank of New York. The two entities had fought for possession of the property in . After the rehabilitation was complete, a judge restored the property to the bank on the condition that it repay the cost of the project. The costs included contractor and management fees.

The appeals court said the trial judge’s decision was correct and that the bank had to pay the costs. However, the court stripped away the $8,151.74 management fee, saying there was no evidence to support it. The bank had argued that Urban Renewal hadn’t rented the property to anyone.

The bank was represented by Chesterfield attorney Scott D. Mosier. Urban Renewal was represented by Jeremiah Kidwell and Jason C. Conkright, of Kidwell & Conkright in Kansas City.

The case is Urban Renewal of K.C. v. Bank of New York, WD69665.
