Criminal Law: Forensic Interview-Victim Credibility
Staff Report//January 19, 2024//
Where a defendant challenged his conviction in a statutory rape and sodomy case, the defendant failed to preserve his claims of error under points one and three, and the trial court did not abuse its discretion by denying the defendant’s request to play the entire first forensic interview as evidence of the victim’s demeanor to impeach her credibility since the defendant was able to sufficiently challenge the victim’s credibility during her cross-examination.
Judgment is affirmed.
State v. Moore (MLW No. 80995/Case No. SD37229 – 18 pages) (Missouri Court of Appeals, Southern District, Growcock, J.) Appealed from circuit court, Scott County, Barker, J.
