Defendant appealed the above-Guidelines sentence imposed following his guilty plea to a sex offense, challenging the substantive reasonableness of the sentence. Defendant argued that the district court improperly relied on statements and objections made by defense counsel in fashioning the sentence.

Where the district court adequately considered the sentencing factors and there was no evidence that it based its decision on defense counsel’s actions, the court upheld defendant’s sentence.

Judgment is affirmed.
