Civil Practice: Res Judicata – Forfeiture
Stephanie Maniscalco//February 2, 2012//
Where a plaintiff brought federal and state constitutional claims against a city arising from a criminal forfeiture proceeding, res judicata barred the plaintiff from bringing the constitutional claims in federal court because the state court action resulted in a final judgment on the merits since the plaintiff prevailed and recovered her vehicle, and the state court action involved the same facts and the same parties, and the plaintiff had a full and fair opportunity to litigate the claims.
Judgment is affirmed.
