Domestic Relations: Divorce-Spousal/Child Support

Listen to this article

Defendant appealed the trial court’s judgment of divorce, arguing that the trial court erred in finding that plaintiff was unable to support herself through appropriate employment, calculating his child support obligation based on plaintiff’s stale income information, and awarding him limited parenting time.

Where there was no basis for the trial court to disregard plaintiff’s current higher income or to find that her income would reduce to its earlier lower levels, the trial court erred in calculating defendant’s child support obligation.

Judgment is affirmed in part and vacated and remanded in part.
