Plaintiff appealed the grant of summary judgment to defendant on plaintiff’s TCPA claim. Plaintiff argued that there were disputed issues of material fact, that he had standing and that the TCPA and its implementing regulations applied to text messages.

Where plaintiff failed to allege any injury traceable to defendant’s conduct, the trial court correctly determined that he lacked standing to bring a TCPA action.

Judgment is affirmed.
