Plaintiff and his counsel moved to quash subpoenas served by defendant. Plaintiff is a serial litigant of Telephone Consumer Protection Act actions. In the present case, defendant sought discovery regarding plaintiff’s previous TCPA cases, but plaintiff declined to respond, claiming that he no longer possessed documents from his prior cases. Defendant then served subpoenas on plaintiff’s current and past counsel.

Where counsel failed to timely object to the subpoenas or more to quash them, counsel waived any objection, and the court declined to quash the subpoenas where they sought information relevant to plaintiff’s damages claim and did not seek privileged information.

Plaintiff’s motion to quash subpoenas denied.
