Environmental: Solid Waste Facility-Denial of Approval

Plaintiff appealed the Administrative Hearing Commission’s dismissal of its claims against the Department of Natural Resources, after the AHC determined that the DNR had properly denied plaintiff’s request for approval of a solid waste facility because an investigation found that the site had a significant potential for collapse.

Where the DNR had merely used administrative tools during its analysis that did not impose binding obligations or consequences on applicants, there was no due process issues and the analysis provided a sufficient basis to deny approval of plaintiff’s request.

Judgment is affirmed.
