Negligence : Social Host – Negligence Per Se – Statutory Amendment

Stephanie Maniscalco//September 7, 2016

Where a woman whose minor son was killed in an alcohol-related car accident sued the party host who knowingly served alcohol to minors, dismissal of the claims against the host is affirmed because an amendment to Section 311.310 on social host liability did not impose a standard of care that would support the negligence per se claim.

Judgment is affirmed.
