Municipal: Officials’ Ethics Rules-Citizen’s Initiative Petition

Plaintiff appealed the adverse summary judgment on her complaint challenging the validity of a citizen’s initiative petition that amended the city charter for St. Louis to add new ethics rules of Board of Aldermen members. Plaintiff argued that the proposition violated the federal and state constitutions and various state statutes.
Although the trial court correctly determined that plaintiff failed to present a justiciable controversy because she failed to allege imminent harm from the enforcement of the proposition, it erred in granting summary judgment on the merits rather than dismissing the petition.
Judgment is affirmed as modified.
