Plaintiff appealed the trial court’s judgment denying her expungement petition in part. Plaintiff sought to expunge records related to her charges of careless and imprudent driving, illegal parking, and DWI. The trial court granted expungement of the C&I and illegal parking convictions but concluded that the expungement statute was inapplicable to expunge records related to her DWI charges and administrative alcohol suspension.

Where prosecutors chose not to pursue a conviction on plaintiff’s DWI charge and instead agreed to a negotiated plea to the C&I charge, the trial court erred in not expunging all records relating to all charges.

Judgment is reversed and remanded.
