The state appealed the trial court’s judgment vacating defendant’s convictions for murder, assault and armed criminal action, arguing that the trial court relied upon inadmissible evidence, excluded impeachment testimony from the state’s investigator and failed to base its judgment on substantial evidence.

Where the trial court properly relied upon documents that were evidence in defendant’s prior state habeas proceeding, there was sufficient evidence to support vacating defendant’s conviction.

Judgment is affirmed.
