Domestic Relations : Parenting Plan – Civil Contempt – Intentional Conduct
Stephanie Maniscalco//February 12, 2016//
Where a mother challenged a judgment finding her to be in civil contempt for failing to comply with a parenting plan, the judgment is affirmed and remanded for further proceedings because the evidence supported the findings that the mother’s actions constituted not merely a lack of encouragement for the child to go with her father, but also a deliberate undermining of father and his efforts to take advantage of his parenting time, and the mother did not meet her burden to show that she did not intentionally violate the court’s order.
Judgment is affirmed; remanded.
